Wealden have today issued the Inspectors Decision on the DRAFT Local Plan. The Inspector has concluded:
“the submitted plan cannot be taken forward to adoption because it has failed one of the requirements for legal compliance, that of the Duty to Co-operate (DtC). In addition, there are some significant failings in respect of the soundness of the submitted Plan”
“the Council has failed in this legal duty and that the submitted plan cannot proceed further in examination”
She was highly critical that Wealden had not adequately worked with or shared information regarding Air Quality on Ashdown Forest with neighbouring authorities in order to satisfy the Duty to Cooperate to ensure those authorities could also meet housing needs.
She also criticised WDC for not following Natural England’s advice with regards air quality, but then also failing to provide insufficient alternative evidence to support its views.
